Please read these Terms and Conditions (“Terms”) carefully before using the Guardian Drive mobile application (the “Service”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
Guardian Drive offers premium features—such as Multi-Child Support for up to 4 devices, advanced Geofencing, and safety alerts—through auto-renewable subscription plans. Terms govern use of the Guardian Drive mobile application and Apple auto-renewable subscriptions.
By downloading or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
Guardian Drive is a tool designed to assist parents and any users in encouraging safe driving habits. It is not a substitute for attentive driving, parental supervision, or driver education. The app acts as an aid to reduce distractions but does not guarantee the safety of the driver or passengers.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that: The app will accurately detect speed or location at all times. The app will successfully block all third-party applications in every instance. The Service will be uninterrupted, timely, secure, or error-free.
To the maximum extent permitted by applicable law, Guardian Drive, its developers, and affiliates shall not be liable for below:
Vehicle Accidents: Any traffic accidents, collisions, injuries, fatalities, or property damage occurring while the Service is in use. The driver remains 100% responsible for the safe operation of the vehicle at all times.
Mobile Device Issues: Any technical issues, hardware malfunctions, battery depletion, or software conflicts caused by the Service (including “fail-safe” modes or app shielding).
Emergency Situations: Any inability to use the mobile device during an emergency due to the app’s restrictive features. Users are encouraged to use the “No Drive Mode” request or emergency bypass features provided by the OS.
Third-Party Actions: Any unauthorized access to a device resulting from a user’s failure to secure their SSO/OTP login credentials.
Parents: You are responsible for configuring restrictions appropriately and discussing app functionality with your child.
Child Users: You must comply with all local traffic laws. You must not attempt to circumvent or “hack” the Service’s restrictions.
Compliance: Users must ensure that the use of this app complies with all local privacy and surveillance laws in their jurisdiction.
All purchases are processed via the Apple App Store or Google Play Store. We are not responsible for billing errors or refund disputes, which must be handled through the respective app store platforms.

a) Subscription Options & Duration: We offer two auto-renewable subscription options:
7-Day Free Trial for new users. No payment during trial. Subscription auto-renews after 7 days. Cancel anytime in Settings > Apple ID > Subscriptions. Paid plan required to continue after trial.
b) Pricing: Subscription prices are clearly displayed within the application prior to purchase and inside the Apple App Store. Prices are shown in the Apple App Store and may vary by region.
c) Payment: Payment will be charged to user’s Apple ID account at confirmation of purchase.
d) Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off or cancelled at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
e) Subscription Management: You can manage, turn off auto-renewal, or cancel your subscription at any time after purchase by going to your device settings: Settings > Apple ID > Subscriptions.
f) Universal Access: Your subscription is linked to your Guardian Drive account. Once upgraded to Premium, your active status and child device profiles automatically sync across all authorized devices where you log in.
g) Privacy in Billing: Guardian Drive does not collect, process, or store your credit card or billing information on our servers. All financial transactions and payment processing are handled exclusively by Apple.
We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for any breach of these Terms, including GPS tampering or unauthorized attempts to uninstall the Child App.
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

We reserve the right to modify these terms at any time. We will provide notice of any significant changes by posting the new Terms within the application.
